DENVER NWSL WEBSITE SEASON TICKET DEPOSIT POLICY

The following terms and conditions, collectively with any and all documents expressly incorporated herein (the “Policy”), govern your participation in the Denver National Women’s Soccer League team’s (“Denver NWSL”) season ticket deposit program.  

Purchase of a Denver NWSL non-refundable season ticket deposit constitutes your agreement with and acceptance of the terms of this Policy, which is a legally binding contract

Denver NWSL Season Ticket Deposit Program

Fans interested in securing season tickets to Denver NWSL home matches are encouraged to place a non-refundable per seat deposit to secure priority for seat selection. Except as expressly set forth in this Policy, all season ticket deposits are non-refundable.

Denver NWSL anticipates (but does not guarantee) that the 2026 National Women’s Soccer League season will be our inaugural season.

The exact date on which tickets for Denver NWSL will go on sale has not yet been determined, but all fans interested in securing season tickets are encouraged to place a non-refundable ticket deposit at their earliest convenience.  

Seat selection priority for season tickets will be assigned based on the order in which deposits are received.  Your priority and opportunity to purchase season tickets will depend on the number of fans who place a deposit in front of you. The earlier you purchase your ticket deposit, the better position you will be in to select season tickets. When you complete your season ticket purchase, the full amount of your ticket deposit will be credited toward your season ticket purchase.  

Denver NWSL cannot accept specific seating requests at this time.  Season ticket deposit holders may only purchase season tickets for their own personal and/or hospitality use, and not for any commercial or resale purposes.   

If a deposit list member decides not to purchase season tickets for any reason (or if Denver NWSL’s efforts to contact the list member fail for any reason), if and when such tickets become available, the ticket deposit is non-refundable.

Ticket deposit purchasers understand and agree that: purchasing a ticket deposit does not guarantee any right to receive the opportunity to purchase season tickets (or any other tickets) within a specified period of time, or ever; the offer to purchase a season seat is at the sole discretion of Denver NWSL, including the number of seat locations made available for purchase by ticket deposit purchasers and the timing of said offers; some seats are retained for Denver NWSL business holds, upgrades, and other internal service or business purposes of Denver NWSL, and these will be given priority over the ticket deposit purchasers; while ticket deposit purchasers will be contacted in priority sequence based on their purchase timing, the opportunity to select seat locations will be limited to the ticket inventory presented by Denver NWSL at the time of selection, and not all seats are eligible; and in the event a ticket deposit purchaser is unavailable at the time of the first attempt of contact by Denver NWSL (whether by phone or email), Denver NWSL reserves the right to continue contacting other ticket deposit members regarding the opportunity to purchase season tickets and is under no obligation to reserve any specific ticket inventory for selection by the ticket deposit purchaser.

All season ticket purchases will be subject to Denver NWSL ticket department policies then in effect (as the same may be amended from time to time) including, without limitation, any applicable personal seat license requirements, personal or household seat maximums, transfer restrictions, and transfer fees.

A ticket deposit purchaser member may be requested to provide Denver NWSL with reasonable proof that they are the Authorized Account Holder of the email address associated with their ticket deposit purchase. In the event of a dispute regarding the identity of a ticket deposit purchaser, the ticket deposit purchaser will be deemed to be the Authorized Account Holder in whose name the email account is registered. “Authorized Account Holder” shall mean the natural person assigned to an email address by an Internet access provider, online service provider, or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.

Indemnification

By purchasing a Denver NWSL ticket deposit, you agree to hold harmless, defend and indemnify Denver NWSL and its affiliates, the National Women’s Soccer League and its member teams, and each of their officers, directors, governors, partners, principals, employees, representatives, agents, affiliates and related entities (all together, the “Released Parties”) against any and all liability, loss, damages, costs and expenses (including reasonable attorneys’ fees), claims, suits and causes of action (however named or described) with respect to or arising out of: (i) the purchase of a ticket deposit; (ii) the administration of ticket deposits and season tickets by Denver NWSL or your participation in the season ticket deposit program; (iii) your violation of this Policy; or (iv) your negligence or willful misconduct. 

Disclaimers; Release

Denver NWSL accepts no responsibility for ticket deposits submissions that are lost, misdirected, or delayed by the purchaser for any reason, nor is any responsibility assumed for incorrect or inaccurate capture of purchase form information, including (but not limited to), technical malfunction, human error, lost/delayed/garbled applications, Internet/e-mail transmission, omissions, interruptions, deletions, defects, or failures of any telephone, technical, network, online, or hardware or software or any combination hereof. Except where excluded by applicable law, Denver NWSL disclaims all conditions, representations and warranties, whether express, implied, statutory or otherwise, related to this Policy, the season ticket deposit list or program, or your participation (or inability to participate) in such program.

Ticket deposit purchasers hereby release, waive, and discharge any and all claims of damage, loss or causes of action (including, negligence), including (but not limited to) for death, personal injury or loss or damage to property, which a ticket deposit purchaser or any of its representatives, heirs, next of kin or assignees (“Purchaser’s Representatives”) may have or which may hereinafter accrue to the deposit list member or Purchaser’s Representatives against any of the Released Parties as a result of the ticket deposit purchase.

Prohibited Conduct

The following is prohibited and will be deemed a violation of this Policy resulting in automatic disqualification from the deposit list and forfeiture of any deposit: (1) violation of or non-compliance with this Policy or any other Denver NWSL policy or program terms and conditions or agreement between you and Denver NWSL or any of its affiliates, including any ticket or facility policy, code of conduct and terms of use or service; (2) impersonating or attempting to impersonate any other person or entity; (3) violation of any applicable law, rule or regulation; (4) your abuse or misuse of the deposit program or any other negligence or misconduct; and (5) any other act or omission which Denver NWSL determines, in its sole discretion, to compromise, threaten, adversely affect or jeopardize (i) the security, fairness, integrity or proper administration of ticket deposits or season tickets, (ii) Denver NWSL’s or the National Women’s Soccer League’s (or any of their affiliates’ or partners’) business, operations, brand or reputation, or (iii) the privacy, security, well-being or safety of any person. Any attempt to deliberately damage any website or to undermine the legitimate operation of the deposit list is a violation of this Policy and criminal and civil laws and, should an attempt be made, Denver NWSL reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

Changes to the Season Ticket Deposit Program and this Policy

Denver NWSL may terminate, modify, suspend or withdraw the ticket deposit program (and/or any aspect thereof, including your participation in the program), in whole or in part, at any time, and for any reason, without notice or liability, in its sole discretion. If Denver NWSL elects to terminate your participation in the program other than for a violation of this Policy or due to an event or circumstance outside of Denver NWSL’s control, Denver NWSL may, in its sole discretion (but is not obligated to), refund your deposit or issue you a credit in the amount of your deposit (which shall be your sole remedy in connection with such termination). Denver NWSL may periodically amend any portion of this Policy in its sole discretion, and all changes are effective when Denver NWSL posts the applicable revised version of this Policy. Denver NWSL will notify you of any material changes to this Policy, as determined in our reasonable discretion. Your continued participation in the season ticket deposit program after such notice means that you accept and agree to be bound by the changes. If you do not agree to the changes, (1) you must promptly inform us of your rejection of the changes, (2) your participation in the season ticket deposit program shall automatically terminate and (3) your sole remedy in connection with such changes and termination shall be, at Denver NWSL’s option, a refund of your deposit or the issuance to you of a credit in the amount of your deposit. 

Liability Limitations

IN NO EVENT WILL DENVER NWSL, THE National Women’s Soccer League and its member teams, THEIR RESPECTIVE AFFILIATES, OR ANY OF THE RESPECTIVE LICENSORS, SERVICE PROVIDERS, PARTNERS, EMPLOYEES, AGENTS, OFFICERS, DIRECTORS OR REPRESENTATIVES OF ANY OF THE FOREGOING BE LIABLE FOR ANY DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH THIS POLICY, YOUR DEPOSIT OR YOUR PARTICIPATION (OR INABILITY TO PARTICIPATE) IN THE TICKET DEPOSIT PROGRAM, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE. DENVER NWSL’S MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS, LOSS, LIABILITY, INJURY, DAMAGES, COSTS AND EXPENSES IN CONNECTION WITH THIS POLICY, YOUR DEPOSIT AND/OR THE TICKET DEPOSIT PROGRAM SHALL NOT EXCEED THE AMOUNT OF YOUR DEPOSIT. THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW (INCLUDING CONSUMER PROTECTION LAW). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. ACCORDINGLY, ALL OR A PORTION OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

Use of Information

You may be asked to provide certain information in connection with your deposit and your participation in the season ticket deposit program. You must ensure that all such information is correct, current, and complete, and you are responsible for contacting us to update your information as it changes. You agree that all such information, and any other information we collect from you, is governed by and subject to our Privacy Policy (which is incorporated herein by this reference), and you (1) consent to all actions we take with respect to your information consistent with our Privacy Policy and (2) otherwise agree to be bound by the Privacy Policy.

Governing Law and Jurisdiction

This Policy and any and all disputes and claims arising out of or related to this Policy or the season ticket deposit program (in each case, including non-contractual disputes and claims) shall be governed by and construed in accordance with the internal laws of the State of Colorado without giving effect to any choice or conflict of law provision or rule of any jurisdiction. Any legal suit, action, or proceeding arising out of or related to this Policy or the season ticket deposit program shall be instituted exclusively in the federal courts of the United States or the courts of the State of Colorado, in each case located in Denver, Colorado. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

You acknowledge and agree that any claim or dispute in any proceeding shall be brought on an individual basis only, and not as a class action or collective action, and there is no right or authority for any dispute or claim to be brought in a purported representative capacity on behalf of the general public or any other persons.

You Must Bring Claims within One Year

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THIS POLICY OR THE SEASON TICKET DEPOSIT PROGRAM MUST BE COMMENCED WITHIN ONE YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY WAIVED AND BARRED.

General Terms

Ticket deposits and the opportunity to purchase season tickets (and all of your other rights and obligations under this Policy) are personal privileges and are non-transferable and not assignable. Denver NWSL may freely assign its rights and obligations under this Policy, without notice to you. Denver NWSL is not responsible or liable for any breach or other non-performance in connection with this Policy (including without limitation failure to conduct the season ticket deposit program in accordance herewith) resulting from any event or circumstance beyond its control.

The invalidity or unenforceability of any provision of this Policy shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, this Policy shall otherwise remain in effect and shall be construed in accordance with its terms as if the invalid or illegal provision were not contained herein. If Denver NWSL does not act to enforce a breach of this Policy, that does not mean that Denver NWSL has waived its right to enforce this Policy.

This Policy constitutes the entire agreement between Denver NWSL and you with respect to the subject matter hereof and supersedes all prior and contemporaneous understandings, agreements, representations and warranties, whether written or oral, with respect to such subject matter. In the event of a conflict between the terms of this Policy and any instructions or interpretations of this Policy given by an employee or representative of Denver NWSL, the terms of this Policy shall prevail.
